We have never had a claim. Why would we want to participate in this program?

If you continue to have no claims, you will continue to have no cost. Since this program operates as a fund, members only pay their own claims. The contracted service fee is offset by investment income earned on the initial funding, so there is no cost at all. The benefits of this program however, are not merely financial.

Having access to the resources available through the contract with Unemployment Consultants ensures that if and when a claim does occur, an agency will be better able to respond.

If economic conditions change and an agency has to lay off staff, guidance can be provided to do so in the most cost effective manner. When termination decisions are being made, guidance is available to assist in handling the matter most judiciously and to perhaps avoid other employment related litigation. In the event that changes in economic conditions result in a high influx of claims, this program allows payments to be structured in a predictable, manageable payment stream.

Training and resources are also available to assist in employment and unemployment issues.

We have claims, but have been successful in fighting them. Why would we want to participate in this program?

Protesting unemployment claims can be time-consuming. Even though claims are not paid to former employees, staff time expended can be costly to an agency and time spent could be better spent on productive agency activities.

Can I pay my unemployment compensation claims out of my tort liability fund?

Section 9-107 of the Tort Immunity Act specifically provides that liabilities or losses incurred under the Unemployment Insurance Act may be met with the funds levied in the tort liability fund.
